FAMELIA SUPPORTS THE RESPONSIBLE SERVICE OF ALCOHOL.

Welcome to Famelia Wine Bar + Bottle Shop, located in Newtown, NSW. Please read the following terms and conditions carefully before using our services.

1. General Terms and Conditions

1.1. Age Restriction: We strictly adhere to the legal drinking age in NSW, which is 18 years. Therefore, only persons aged 18 years or above are allowed to purchase (and consume) alcohol from our wine bar and bottle shop. By using our services, you confirm that you are at least 18 years of age. Our staff members are required to ask for identification to verify age, and we reserve the right to refuse service to anyone who appears underage or fails to provide valid identification.

1.2. Liquor Licensing: We hold a valid liquor license issued by the NSW Government’s Office of Liquor, Gaming, and Racing. Our wine bar and retail bottle shop operate in accordance with the liquor laws and regulations of the state of NSW. By using our retail services, you agree to comply with these laws and regulations. For online deliveries, each state and territory in Australia has its own liquor laws and regulations. By using our online bottle shop, you agree to comply with the liquor laws and regulations of your state or territory.

1.2.1. New South Wales (NSW): The Liquor Act 2007 regulates the sale, supply, and consumption of alcohol in NSW. It is an offence to sell or supply alcohol to anyone under the age of 18 years. Maximum penalties apply.

1.2.2. Victoria (VIC): The Liquor Control Reform Act 1998 regulates the sale, supply, and consumption of alcohol in Victoria. It is an offence to supply alcohol to a person under the age of 18 years (Penalty exceeds $7,000), and for a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $600).

1.2.3. Queensland (QLD): The Liquor Act 1992 regulates the sale, supply, and consumption of alcohol in Queensland. It is an offence to sell or supply alcohol to anyone under the age of 18 years. Maximum penalties apply.

1.2.4. South Australia (SA): The Liquor Licensing Act 1997 regulates the sale, supply, and consumption of alcohol in South Australia. It is an offence to sell or supply alcohol to anyone under the age of 18 years. Maximum penalties apply.

1.2.5. Western Australia (WA): The Liquor Control Act 1988 regulates the sale, supply, and consumption of alcohol in Western Australia. It is an offence to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises; or for a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises. Maximum penalties apply.

1.2.6. Tasmania (TAS): The Liquor Licensing Act 1990 regulates the sale, supply, and consumption of alcohol in Tasmania. It is an offence to sell or supply alcohol to anyone under the age of 18 years. Maximum penalties apply.

1.2.7. Australian Capital Territory (ACT): The Liquor Act 2010 regulates the sale, supply, and consumption of alcohol in the ACT. It is an offence to sell or supply alcohol to anyone under the age of 18 years. Maximum penalties apply.

1.2.8. Northern Territory (NT): The Liquor Act 2019 regulates the sale, supply, and consumption of alcohol in the NT. It is an offence to sell or supply alcohol to anyone under the age of 18 years. Maximum penalties apply.

1.3. Bottle Shop Store: We offer a bottle shop store service where you can purchase wine, beer, and spirits for take away. Our store is open during business hours, and all sales are subject to NSW liquor laws and regulations.

1.4. Bookings: We accept bookings for sittings, events, and private functions. Bookings can be made in person, over the phone, or through our website. We understand that unexpected situations may arise, and plans may change. If you cannot make your booking or event, please notify us as soon as possible. For standard sitting bookings, please note that we require a minimum of 24 hours’ notice for cancellations or changes. Failure to provide timely notice may result in a cancellation fee. For events, refunds will only be provided at our discretion. If you provide us with more than 48 hours notice, we can move your booking to a new event, free of charge. With less than 48 hours notice you will not eligible for a refund, however as a gesture of goodwill we will credit you 50% of your ticket to use against a future event. You also have the option to gift the event to a friend or change the name on the reservation. We are here to help you and ensure that your experience with us is as enjoyable and stress-free as possible.

1.5. Online Bottle Shop: We also offer an online bottle shop service where you can purchase wine, beer, and spirits for delivery. By using our online bottle shop, you agree to provide accurate information and comply with all of your state's liquor laws and regulations.

1.6. Stock Availability and Pricing: All products displayed on our online bottle shop are subject to availability and potential price increases due to government charges or wholesale prices. We reserve the right to modify or discontinue any product at any time without notice.

1.7. Payment: We accept payment in-store via cash or major credit cards. Our website supports payments using major credit cards, as well as Shop Pay, Paypal and Google Pay.

1.8. Delivery: We deliver our products to all areas of Australia, subject to the liquor laws and regulations of your state or territory. For orders placed before 10am, we aim to dispatch orders within 48 hours. However delays can occur. Delivery times may vary depending on your location. Delivery fees may apply.

2. Liability and Responsibility

2.1. Famelia shall not be held responsible for any injury, loss, or damage that may result from the consumption of alcohol or the use of our services.

2.2. You acknowledge that it is your responsibility to ensure that you and your guests consume alcohol responsibly and in moderation. We reserve the right to refuse service or ask customers to leave the premises if we believe they are intoxicated or behaving in a disruptive manner.

2.3. We shall not be held responsible for any damages or losses resulting from your use of our services, including but not limited to, loss of income, revenue, profits, or business interruption.

3. Intellectual Property

3.1. All content, including but not limited to, logos, graphics, and text, on the Famelia website and social media accounts are the property of Famelia and are protected by Australian and international copyright laws.

3.2. You may not use, copy, reproduce, modify, or distribute any content from our website or social media accounts without our prior written consent.

4. Privacy Policy

4.1. We respect your privacy and will collect and use your personal information in accordance with our Privacy Policy, which can be found on our website.

5. Loyalty Program

5.1. When providing your email address to Famelia, you will automatically be registered for our Loyalty Program. Within this program, members receive points for purchases and engagements, which can be accumulated and redeemed for rewards.

6. Governing Law

6.1. These terms and conditions are governed by the laws of NSW and the Commonwealth of Australia.

6.2. Any disputes arising from the use of our services or these terms and conditions shall be resolved in accordance with the laws of NSW and the Commonwealth of Australia.
